1. Agreement
These Terms of Use (“Terms”) are a binding agreement between you and ThumbSweep (“ThumbSweep,” “we,” “us,” or “our”) governing your use of the ThumbSweep iOS application (the “App”) and related website pages we operate for the App.
By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
If you obtained the App from the Apple App Store, you also acknowledge that Apple’s media and App Store terms may apply to the licensed application transaction. In the event of a conflict between these Terms and Apple’s required Licensed Application End User License terms for App Store apps, Apple’s required terms control to the extent required by Apple for that conflict.
2. The service
ThumbSweep helps you review media in your Apple Photos library and mark items to keep or delete using swipe-based and related review flows. Features may include browsing by month, screenshots, videos, random order, oldest-first order, an in-app pending-delete list, undo within a session where available, optional local reminders, and optional Premium access.
We may improve, change, or discontinue features. We do not guarantee that any particular feature will remain available forever.
3. Eligibility
You must be able to form a binding contract in your jurisdiction. The App is not directed to children under 13. If you are under the age of majority where you live, you may use the App only with involvement of a parent or legal guardian who agrees to these Terms.
4. Photo Library permission and your responsibility
The App requires permission to access your Photo Library to show media and to delete media you confirm for deletion. You are solely responsible for:
- which items you mark for deletion and confirm deleting;
- reviewing selections carefully before confirming;
- backing up important photos/videos if you need independent copies;
- understanding that confirmed deletions are performed through Apple’s Photos APIs and typically move items into Apple Photos’ Recently Deleted album for a limited recovery window (about 30 days, subject to Apple’s behavior and your settings);
- any consequences of emptying Recently Deleted or of iCloud Photos syncing deletions across devices.
ThumbSweep is not a backup service. We do not store copies of your photos on a ThumbSweep server.
5. No ThumbSweep photo server
ThumbSweep does not operate a server that receives your photo or video files for cleaning. Media processing for review and deletion is performed on your device using Apple frameworks (and, when needed for display, Apple’s iCloud Photos retrieval to your device).
6. Free use and Premium
Without Premium, the App may limit usage (currently a free daily swipe allowance, such as 50 swipes per day). Limits, product names, prices, and benefits may change; the App Store product page and in-app purchase screens control what is offered at the time of purchase.
Premium, when active, is intended to remove the free daily swipe limit so you can review without that cap. Premium does not guarantee unlimited device storage, faster iCloud downloads, or recovery of items after you empty Recently Deleted.
7. Purchases, subscriptions, trials, and Apple’s role
Paid products may include auto-renewable subscriptions (for example monthly or yearly) and/or a non-consumable lifetime purchase, as offered in the App.
- Payment is charged to your Apple ID account through the App Store.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, according to Apple’s rules.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price shown by Apple.
- Any unused portion of a free trial, if offered, may be forfeited when you purchase a subscription, where allowed by Apple.
- You manage and cancel subscriptions in your Apple ID account settings: https://apps.apple.com/account/subscriptions.
- Refund requests are handled by Apple under Apple’s refund policies. Contact Apple Support / report a problem for App Store purchases.
Purchase unlocking may use RevenueCat in addition to StoreKit. Apple is the merchant of record for App Store purchases.
8. License to use the App
Subject to these Terms, ThumbSweep grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the App on Apple devices you own or control, as permitted by the App Store Rules.
You may not:
- copy, modify, redistribute, sell, lease, or reverse engineer the App except to the extent applicable law forbids this restriction;
- circumvent usage limits, licensing, or security mechanisms;
- use the App for unlawful purposes;
- interfere with the App’s normal operation or other users’ devices;
- misrepresent affiliation with ThumbSweep.
9. Intellectual property
The App, including its name, logos, visual design, and software, is owned by ThumbSweep or its licensors. © 2026 ThumbSweep. These Terms do not transfer ownership of any intellectual property to you.
Your photos and videos remain yours (or the rightful owner’s). We do not claim ownership of your media.
10. Support
Support is provided on a reasonable-efforts basis via email: thumbsweep@gmail.com. We do not promise uninterrupted support coverage or specific response times, except where mandatory law requires otherwise.
11. Disclaimer of warranties
THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBSWEEP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- the App will be error-free, uninterrupted, or available on every device/OS version;
- space-saved estimates will be exact;
- every photo/video will load if iCloud originals are unavailable offline;
- deleted items will always be recoverable for any specific period (recovery depends on Apple Photos / your actions).
Some jurisdictions do not allow certain warranty exclusions. In those places, exclusions apply to the fullest extent allowed.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBSWEEP AND ITS OPERATORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR MEDIA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP OR WEBSITE — INCLUDING DAMAGES ARISING FROM DELETION OF PHOTOS OR VIDEOS YOU CONFIRMED FOR DELETION — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBSWEEP’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO THUMBSWEEP VIA THE APP STORE FOR PREMIUM ACCESS IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $10.
THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SURVIVE TERMINATION OF THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, LIABILITY IS LIMITED TO THE MINIMUM AMOUNT PERMITTED.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, certain liabilities for fraud or personal injury where such exclusion is prohibited).
13. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ThumbSweep from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the App, your violation of these Terms, or your deletion of media that you were not authorized to delete.
14. Termination
You may stop using the App at any time by deleting it. We may suspend or stop providing the App or related site materials at any time. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnity, and governing law) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules, except where mandatory consumer-protection laws in your country of residence require otherwise (in which case those mandatory protections still apply for your benefit).
Except where prohibited, disputes will first be addressed in good faith by contacting thumbsweep@gmail.com. If unresolved, courts located in California, USA, will have exclusive jurisdiction, unless mandatory law gives you the right to bring claims in your home courts.
App Store purchase and refund disputes may need to be handled with Apple under Apple’s processes.
16. Export and compliance
You must comply with applicable export control and sanctions laws and may not use the App if you are prohibited from receiving Apple software or App Store products under those laws.
17. Changes
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. If a change is material, we may also provide additional notice in the App or on the site when practical. Continued use after the effective date of changes constitutes acceptance, except where mandatory law requires a different process.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and ThumbSweep regarding the App, superseding prior understandings on that subject. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the App.
